What if I was at fault?
It does not matter. Workers’ compensation is no-fault insurance. Whenever you sustain a work injury, you should be covered by your employer’s insurance even if you caused the accident.
What injuries qualify?
You can recover workers’ compensation benefits for:
- • injuries you sustained from an accident at work (such as falling from a ladder); and/or
- • occupational injuries, which are caused by repetitive movements at work (such as carpal tunnel).
What benefits can I get?
Workers’ compensation insurance should cover all medical treatments related to your injuries, as well as your travel expenses to and from treatment. (However, you usually have to use a doctor on your employer’s policy.)
For as long as you remain injured, the insurer should give you regular payments for:
- • temporary partial disability – if you have a temporary injury, and you can still do “light duty” at work;
- • permanent partial disability – if you have a permanent injury, and you can still do “light duty” at work;
- • temporary total disability – if you have a temporary injury that prevents you from working at all; or
- • permanent total disability – if you have a permanent injury that prevents you from working at all.
And if your injury keeps you from returning to your old job, workers’ comp should also pay for your vocational rehabilitation.
In the event a work injury results in the employee’s death, workers’ comp should pay death benefits to the family.
Do I need an attorney?
Your employer’s workers’ compensation insurance company will try to get away without paying you what you are entitled to. So you are strongly advised to retain an attorney to fight for every dollar the law allows.
